Licensing basics

  • A person applying for a learner license must be at least 15 but no more than 18 years of age.
  • A provisional license is a driver license issued to persons 16 to 18 years of age that has the Phase Two GDL driving restrictions applied.
  • During Phase Two, drivers may not drive between midnight and 5:00 a.m. unless necessary for work, a school-related activity, or a medical emergency.
  • During Phase Two, drivers may not have more than one passenger in the vehicle under age 21 who is not a family member.
  • You must score a grade of 70 percent or better to pass any knowledge exam.
  • A driver must notify the Texas Department of Public Safety of a change of address within 30 days.
  • After passing all applicable exams, you will be issued a temporary license, which you may use for 45 days or until you receive your permanent license.
  • New residents exchanging a valid out-of-state license have 90 days to establish residency in Texas in order to secure a Texas driver license.
  • A learner license will indicate "Learner License" on the front of the card and expire on the minor's 18th birthday.

Sign shapes & colors

  • Red means stop, yield, or do what is posted on the sign.
  • Green indicates permitted movements and direction guidance.
  • Blue is used for motorist services guidance, such as gas, food, and lodging.
  • Orange is used to warn of construction and maintenance areas.
  • The round shape is used for railroad advance warning signs.

Right-of-way & turning

  • Use your right turn signal and slow down at least 100 feet from the corner.
  • Use the left turn signal and slow down at least 100 feet from the corner.
  • When signs and signals control an intersection, you must obey them; right-of-way rules for uncontrolled intersections do not apply there.
  • If you drive on a single or two-lane road that intersects a divided road or one with three or more lanes, you must yield to vehicles on that larger road.
  • When turning left, always yield the right-of-way to any vehicle coming straight through the intersection from the other direction.

Traffic signals

  • At a steady red light, you may turn right after stopping unless prohibited by law or a posted sign.
  • You may also turn left on a steady red light if both streets are one-way, unless prohibited by law.
  • You can turn left on a green light, but you must yield the right-of-way to all traffic approaching from the opposite direction before turning.
  • Modern roundabouts use yield signs rather than traffic lights to control vehicles entering the intersection.

Speed & following distance

  • The handbook states that for speeds of 30 mph or less, the minimum following time in good road conditions is 2 seconds.
  • For speeds above 30 mph, the handbook instructs drivers to maintain a 4-second gap during good road conditions.
  • The Approximate Stopping Distances table states it takes the average person about 1-1/2 seconds to think, react, and apply the brakes.
  • Table 22 lists the speed limit for an urban district as 30 mph.
  • Table 22 lists the speed limit for an alley as 15 mph.

Parking rules

  • You may not park or stand a vehicle within 15 feet of a fire hydrant.
  • You may not park or stand within 20 feet of a crosswalk at an intersection.
  • You may not park or stand within 20 feet of the driveway entrance to any fire station.
  • Do not park a vehicle, occupied or not, within 50 feet of the nearest rail of a railroad crossing.

Seat belts & child safety

  • Any child under 8 years old must be secured in a federally approved child car seat unless the child is more than 4'9" tall.
  • Driving a vehicle without wearing a safety belt carries a fine of $25 to $50.
  • A passenger under 8 years old and less than 4'9" tall riding without proper securement in a child safety seat results in a fine of $25 to $250.
  • The driver and all passengers, regardless of age, are required to use safety belts if occupying a seat equipped with one.
  • The handbook states your chances of being killed are five times greater if you are thrown from your car.

Distracted driving

  • The handbook states: 'If drivers react a half-second slower because of distractions, crashes double.'
  • The handbook states that distracted driving can result when you perform any activity that may shift your full attention from the driving task.
  • The handbook advises drivers to adjust all mirrors for the best all-round visibility before starting their trip, rather than while driving.

Railroad & light rail crossings

  • When approaching a railroad grade crossing under conditions requiring a stop, you must stop between 15 and 50 feet from the nearest rail.
  • A person who fails to obey the law regarding railroad grade crossings is subject to a fine of $50 to $200.
  • If red lights are flashing at a railroad crossing, stop. If a train is approaching, remain stopped until the train passes and the lights stop flashing.
  • If the railroad crossing gates have been lowered, stop, remain stopped, and wait until the train passes and the gates are raised before crossing.
  • Trains do not and cannot stop at crossings. Trains always have the right-of-way.

Emergency vehicles & work zones

  • You are not allowed to follow within 500 feet of a fire truck answering an alarm or an ambulance when the flashing red lights are on.
  • When the posted speed limit is less than 25 mph, you must slow to a speed less than 5 mph when passing a stopped emergency vehicle with its lights activated.
  • The law requires drivers to reduce their speed to 20 mph below the speed limit if they do not move out of the lane closest to the stopped vehicle.
  • Do not drive or park on the street where a fire truck has answered an alarm.
  • A flag person wears an orange vest, shirt, or jacket and uses stop/slow paddles or red flags to direct traffic through work zones.

Financial responsibility & insurance

  • As of January 1, 2011, the minimum liability insurance in Texas is $30,000 against injury or death of one person.
  • The minimum liability insurance in Texas is $60,000 against injury or death of two or more individuals.
  • The minimum liability insurance in Texas is $25,000 against property damage.
  • You must file a written report with TxDOT on a TxDOT-specified form no later than the 10th day after the crash.
  • An owner must register a newly purchased vehicle within 30 days of purchase.

Alcohol & drugs

  • In Texas, a person age 21 and over is considered legally intoxicated if the person has a BAC of 0.08 or more.
  • A minor whose specimen confirms a detectable amount of alcohol below 0.08 will have their license suspended for 60 days on the 1st offense.
  • An adult who refuses to give a blood or breath specimen will have their driver license suspended for 180 days (or up to 730 days for subsequent offenses).
  • In 2018, TxDOT reported that nearly 7% of all fatal crashes involved a driver under the age of 21 who was under the influence of alcohol.
  • Conviction of the open container offense is punishable by a fine not to exceed $500.

Pedestrian rights

  • A first conviction for failing to yield the right-of-way to a school bus displaying flashing red lights carries a fine of $500 to $1,250.
  • Without a sidewalk, pedestrians should walk on the left side of the road, facing traffic, and step off the pavement when a car approaches.
  • Pedestrians should always wear white or light-colored clothing and/or carry a light or reflector when walking at night.

Sharing the road

  • The average passenger car traveling at 55 mph can stop in approximately 240 feet, which is about three-fourths the length of a football field.
  • A neighborhood electric vehicle may only be operated on a street or highway when the posted speed limit is 45 mph or less.
  • Bicyclists must always obey all traffic laws, signs, and signals, and must stop at all stop signs and red lights, just like motor vehicle drivers.
  • A bicyclist must always ride with the flow of traffic and should never ride opposite the flow of traffic.
  • A motor assisted scooter is defined as having a gas or electric motor not exceeding 40 cc.

Signals & vehicle controls

  • Use low beam headlights within 500 feet of an approaching vehicle.
  • The foot brake must stop the car within a distance of 25 feet at a speed of 20 mph.
  • All vehicles must be equipped with two taillights, except cars manufactured before 1960, which are only required to have one.
  • Horns must be heard for a minimum distance of 200 feet.

Emergencies and special situations

  • Texas requires a crash report when no officer investigates and the crash results in injury, death, or apparent damage of $1,000 or more.
  • Stop serious bleeding with thick cloth pads, as clean as possible, applied with pressure by hand or by bandaging.
  • The handbook lists staying alert and keeping your eyes moving to track what is happening at all times as a key defensive driving practice.

Driving record & suspensions

  • Administrative License Revocations (ALR) require a $125 reinstatement fee.
  • For individuals under 21 years of age, DPS is authorized to suspend a license under ALR for any detectable amount of alcohol.

Road signs

  • The sign shows the height of the underpass; drivers should not try to enter if their load is higher than the figure shown on the sign.

Pavement markings

  • White lines separate lanes of traffic moving in the same direction, such as on a one-way street; yellow lines separate opposing traffic.

Freeway driving

  • Exit signs are usually placed at least 1,000 yards ahead of the exit, so move into the proper lane well in advance, especially in heavy traffic.
